The petitioner seeks bail in connection with Case No.C-III-290 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise (Amended) Act 2018. The accusation is of recovery of 396.360 liters Indian Made Foreign Liquor, kept in several bottles of 180 ml., beneath the stair of the house of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that the house from where the alleged recovery is said to be made is the joint house of the petitioner and the petitioner had no knowledge about keeping of the liquor beneath the stair

Patna High Court CR. MISC. No.80199 of 2019(2) dt.06-12-2019 2/2 of the house by his family members. The petitioner has no criminal antecedent and is in custody since 10.11.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan, in connection with Case No.C-III-290 of 2019.
