JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 16-12-2025 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State.

2. The petitioner has prayed for bail in connection with Aunsi P.S. Case No. 46 of 2025 registered for the offence punishable under Sections 80 and 3(5) of the B.N.S.

3. The case of the prosecution, in short, is that the sister of the informant Arti Kumari (deceased) was married to one Ritesh Paswan. It is alleged that she was subjected to cruelty on account of non-fullfilment of dowry demand. It is further alleged the all the in-laws have killed her.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

He was separate in mess and residence from the deceased and her husband. The nature of allegation is general and omnibus. He is having no criminal antecedent and he is languishing in judicial custody since 26.07.2025.

5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipatti in connection with Aunsi P.S. Case No. 46 of 2025.
