Petitioner, who is in custody, seeks bail in connection with Danapur P.S. Case No. 644 of 2018 arising out registered for the offences punishable under Sections 420, 468, 120(B) of the Indian Penal Code and Section 63 of the Copyright Act, 1957 and Section 103 and 104 of the Trade Marks Act, 1999.
Informant has stated in his written complaint that Kedar Auto Parts, Singh Auto parts and other shop owners are selling spurious mobile and spare part of his company in the market openly thereafter S.H.O., P.S. Danapur with his team raided on 18.09.2018 at the premises of Kedar Auto Parts and
Patna High Court Cr.Misc. No.66471 of 2018(2) dt.05-11-2018 2/2 recovered 120 mobile cans of 900 m.l. each containing spurious mobile of Hero Company and premises of Singh Auto Parts 250 pieces of spurious parts of Hero Company.
It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this present case. Petitioner is the owner of Kedar Auto Parts and has been purchasing articles from the authorized dealers. Petitioner's business i.e. Keadar Auto Parts is a proprietorship and is duly registered under Form GST REG 06. Petitioner has no criminal antecedent and is in custody since 19.09.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I, Danapur, in connection with Danapur P.S. Case No. 644 of 2018 .
