The petitioner seeks bail in connection with Udwantnagar P.S. Case No.321 of 2019 registered under Sections 341, 323, 379 and 307/34 of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that in the evening of 11.08.2019, the informant Mukul Yadav along with his son Munna Kumar was going to Dariyapur near his truck. In the way, 5 persons, named in the F.I.R., including the petitioner surrounded the informant. At that time, Ashok Yadav caught hold of the informant and this petitioner started to take money from the pocket of the informant. Thereafter, on the order of Mutur

Patna High Court CR. MISC. No.77390 of 2019(2) dt.28-11-2019 2/2 Yadav, Lalbabu Yadav started to commit "Maar-Peet" with the informant through lathi. After that, this petitioner took cash Rs.36000/- from the pocket of the informant and Lal Das Yadav shot fire at him causing injury on his left chest. On reaching of the family members of the informant, all fled away from there. Learned counsel appearing on behalf of the petitioner submits that the specific allegation to shot fire at the informant causing injury on his left chest is against Lal Das Yadav. The petitioner has been named in the F.I.R. with the allegation of snatching Rs.36000/- from the pocket of the informant. The petitioner has no criminal antecedent and is in custody since 13.09.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Udwantnagar P.S.
