The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 121, 379, 414, 120(B)/34 of the Indian Penal Code as well as Sections 25(1-a), 25(1-aa), 25(1-b)a, 26, 35 of the Arms Act and Section 39 of the U.A.P. Act.

Petitioner is not named in the F.I.R.

Submission is that name of the petitioner surfaced in the confessional statement of co-accused before the Police, which is no evidence in the eye of law. Though the petitioner has got criminal cases against him, however, in all the cases petitioner is on bail and for that reason the Police has implicated the petitioner in this case also.

No.78296 of 2019(2) dt.02-12-2019 2/2 Considering the entire facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Muffasil (Munger) Police Station Case No.334 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
