2. The petitioners seek bail in a case registered for the offence punishable under Sections 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.

3. Earlier, prayer for bail of the petitioners was rejected on 18.10.2024 with liberty to them to renew their prayer for bail after framing of charge.

4. Learned counsel for the petitioners submits that the petitioners is innocent and have been falsely implicated in this case. He submits that now the charge has been framed against the petitioner on 21.10.2024. He further submits that petitioner no. 1 has one criminal antecedent and rest of the

Patna High Court CR. MISC. No.87285 of 2024(2) dt.28-01-2025 2/2 petitioners have no criminal antecedent as stated in para-3 of the bail application and they are languishing in judicial custody since 14.08.2024.

5. Learned APP for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case, let the above named petitioners, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sessions Trial No. 1251 of 2023 arising out of Chiraiya (Shikarganj) P.S. Case No. 254 of 2022, subject to the condition that the petitioners shall co-operate in the trial and if they fail to appear on two consecutive dates their bail bonds shall be liable to be cancelled.
