Petitioners seek bail in connection with Daudnagar P.S. Case No. 300 of 2018 instituted for the offence under Section(s) 341, 323, 307, 379, 354, 504,498(A) of the Indian Penal Code. Petitioner no. 1 is husband of sister of informant. It is alleged in the written report that sister of informant was married with petitioner no. 1 twelve years ago. She was not blessed with child due to which she was tortured by these petitioners and others. It is alleged that on the date of occurrence the informant was informed by his sister that she was brutally assaulted by her husband and other family members. Thereafter on the same day at about 9:00 A.M., informant was informed by a villager that his sister was assaulted by the family members of her

Patna High Court Cr.Misc. No.66855 of 2018(3) dt.06-12-2018 2/2 Sasural and was thrown in the canal but they have rescued her and have taken in the village. The informant rushed there and found his sister lying unconscious in the house of one Ibrar Mistri. In the meantime, B.D.O., Daudnagar arrived and took his sister to P.H.C., Daudnagar from where she was referred to Sadar Hospital, Aurangabad.

Injury report of sister of informant is annexed as Annexure-2, wherein doctor has found no any external injury over the chest. On the right side of head contusion of size 1 1⁄2" x 1⁄2" has been found. Doctor has opined the injury to be simple in nature.

Petitioners are in custody since 01.09.2018.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M. Daudnagar, in connection with Daudnagar P.S. Case No. 300 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners. (Sanjay Priya, J) rakhi/- U T
