JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 Petitioners seek bail in anticipation of their arrest in connection with Shambhuganj P.S. Case No. 79 of 2019 registered for the offences punishable under Sections 341, 323, 337, 307, 379, 354, 354B, 504, 506, 34 of the Indian Penal Code and Section 8 of POCSO Act.

As per prosecution case, one Bidur Shekhar Singh tried to outrage the modesty of minor daughter of the informant and when her second daughter came to rescue her, her clothes were also torn and she was assaulted and thereafter all the accused persons, including the petitioners came in order to assault them and when police came they fled away.

Patna High Court CR. MISC. No.86591 of 2019(2) dt.23-01-2020 2/2 Submission of learned counsel for the petitioners is that the main accused is Bidur Shekhar Singh and the injuries are simple in nature.

Heard learned APP, who has opposed the prayer for anticipatory bail stating that FIR disclosed that due to fear of these people informant along with her daughters were residing at Delhi and when she came back such occurrence took place. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioners. They have to surrender and pray for regular bail. This application is, accordingly, dismissed.
