2. The petitioner seeks regular bail in a case registered for the offence under Sections 20/22 of the N.D.P.S. Act.
3. As per the prosecution case, Brown Sugar was recovered from the possession of one Pritam Kumar and Himanshu.
4. Learned counsel for the petitioner submits that the petitioner is in custody since 27.06.2023. No recovery has been made from the possession of the petitioner. He further submits that from the prosecution it appears that the petitioner was a consumer of Narcotic substance and not the carrier.
5. Learned A.P.P. has vehemently opposed the
Patna High Court CR. MISC. No.3174 of 2024(2) dt.31-01-2024 2/2 prayer for bail.
6. Considering the facts and circumstances of the case, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Bhagalpur/concerned Court below in connection with Kahalgaon P.S. Case No. 762 of 2023 subject to the condition that:- 7(1). The petitioner will mark his attendance at the Pirpainti Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. (Sandeep Kumar, J) Shishir/- U T
