JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-04-2019 This is an application for grant of anticipatory bail in connection with Andhra Thadi P.S. Case No. 24 of 2017, disclosing offences under Sections 341, 323, 354(B), 504 of the Indian Penal Code.
Allegation against the petitioner is of trying to outrage the modesty of the informant.
Submission of learned counsel for the petitioner is that he is retired government servant from the RAW and aged about 65 years that he has mentioned in para 10 and the materials collected during the investigation also does not disclose about the outraging of modesty and only disclosed a scuffle and a Title Suit has been filed by the petitioner being Title Suit No.169 of 2016 against Ramgulam Roy, who is father-

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Jhanjharpur District- Madhubani, in connection with Andhra Thadi P.S. Case No. 24 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
