The petitioner seeks bail in Wazirganj P.S. Case No. 249/2018, instituted under Section 414 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner has clean antecedent. Name of this petitioner has come in the confessional statement of co-accused Mantu Kumar. It is alleged in the written report that on getting information about dealing relating to sale of stolen motorcycle, police party reached near Punawa Middle School. Seeing the police party two persons started running away with motorcycle but one of them, namely, Mantu Kumar was apprehended with stolen motorcycle. On the disclosure of aforesaid Mantu Kumar,

Patna High Court Cr.Misc. No.66951 of 2018(3) dt.28-11-2018 2/2 one motorcycle is alleged to have been recovered from the house of this petitioner.

Learned counsel for the petitioner has submitted that alleged motorcycle was recovered from the joint house of the petitioner, where other family members are also residing. It is submitted that co-accused Mantu Kumar has already been granted bail by this Court in Cr. Misc. No. 66081/2018 dated 05.11.2018.

Petitioner is in custody since 27.08.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Wazirganj P.S. Case No. 249/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
