====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103(1), 109, 115(2), 126(2), 352, 351(2), (3) and 3(5) of the B.N.S., 2023.
3. The allegation in the F.I.R. is that the accused persons, being six in number, indulged in assaulting the informant and others, and Mahesh Mukhiya assaulted the father of the informant by means of an iron rod, while Jito Mukhiya assaulted the mother of the informant by means of a lathi, subsequently causing her death.
4. Learned counsel for the petitioner submits that the F.I.R. itself discloses that on a very trivial issue dispute took place between Mahesh Kumar and the brother of the informant, which escalated into the present incident. There is a general and omnibus allegation of assault against this petitioner. The specific

No.84066 of 2025(2) dt.04-12-2025 2/2 allegation of assaulting the deceased is against Jito Mukhiya and the allegation of assault upon the father of the informant, who has also received grievous injury, is against Mahesh Mukhiya, who are also in custody. Co-accused Ganesh Mukhiya, who has a similar and identical role, has already been granted bail by this Court vide order dated 17.11.2025 passed in Cr. Misc. No. 71583 of 2025. The petitioner is in custody since 08.06.2025 and the charge-sheet has been submitted in this case.
5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul, in connection with Supaul Nadi (Riverine) P.S. Case No. 48 of 2025/G.R. No. 968 of 2025.
