JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 806C of 2013, disclosing offences under Sections 498, 323 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
Allegation against the petitioner is of subjecting the complainant-wife with cruelty and harassment with respect to demand of rupees two lacs and also ousted her. Submission of learned counsel for the petitioner is that now the ex-parte divorce decree has also been passed in favour of the petitioner by decree dated 08.12.2016 and the opposite party no.2 has not filed any petition for setting-aside the divorce decree.

No.74763 of 2018(3) dt.11-04-2019 2/2 Heard learned A.P.P. as well as learned counsel for the complainant, they have opposed the prayer for anticipatory bail of the petitioner, however admitted the fact that she has not filed any petition for setting-aside the ex-parte divorce decree. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Danapur, in connection with Complaint Case No. 806C of 2013, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
