2. The petitioners are seeking regular bail in connection with Rahui P.S. Case No. 17 of 2024, registered for the offences punishable under Sections 379 of the Indian Penal Code and Section 136 of the Indian Electricity Act, 2023.

3. As per allegation, some unknown persons committed theft of three phase four wire AB cable due to which the Electricity Department suffered a loss of approximately Rs. 1,35,000/-.

4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Nothing was recovered from possession

Patna High Court CR. MISC. No.87915 of 2024(2) dt.20-02-2025 2/2 of the petitioners. He has further submitted that on exactly similar footing, co-accused Vinod Kumar has been granted bail by this Court. The petitioners are under custody since 09.05.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned ACJM-II, Nalanda at Biharsharif in connection with Rahui P.S. Case No. 17 of 2024, subject to the following condition that the petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.

7. Before accepting the bail bond, the learned court below shall verify the criminal antecedents of the petitioners and if they are found that they are involved in any case other than the case as mentioned in para-3 of the bail petition, their bail bonds shall not be accepted.
