1. The petition by way of this writ petition prays as under:

"1. That, this is an application for issuance of an appropriate Writ or Writs setting aside the office order dated 24.08.2018 contained in Memo No. 1146 issued by the District Education Officer, Nalanda by which he has rejected the claim of the petitioner by upholding the previous decision dated 14.11.2017 whereby Primary School Biyavani Kharjamma was merged with Upgraded Middle School, Biyavani

Patna High Court CWJC No.21852 of 2018(4) dt.21-02-2023 2/2 without appreciating and considering the provisions of the Right of Children to Free and Compulsory Education Act, 2009 (hereinafter referred to as the "Education Act, 2009") and/or grant any other relief/reliefs for which the petitioner is legally entitled in the facts and circumstances of the case."

2. Admittedly, the orders passed by the District Magistrate are challengable before the Divisional Commissioner, granting liberty towards aforesaid.
