JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363,366A,34 of the Indian Penal Code.

Although there is specific allegation against the petitioner that he kidnapped the informant's minor girl but admittedly, the statement of the victim was recorded under Section 164 Cr.P.C. in which she denied the prosecution story which is evident from perusal of the order dated 09.07.2019 passed by coordinate Bench of this Court in Cr. Misc. No. 42344 of 2019.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Bagaha, West
