====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-02-2026 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 447, 341, 323, 324, 308, 354, 379, 504/34 of the Indian Penal Code.
3. On the alleged date and time of occurrence, all the FIR named accused persons, including these petitioners, came at the door of the informant and started abusing him and on protest, co-accused Shiv Kumar Yadav assaulted informant by means of farsa over his head and when Sita Ram came to save
Patna High Court CR. MISC. No.86296 of 2025(2) dt.09-02-2026 2/3 informant, petitioner no. 3 assaulted by means of spade over his head. It is further alleged that accused persons assaulted nephew of the informant by means of butt of pistol and misbehaved with wife of informant and also damaged house-hold articles.
4. Learned counsel for the petitioners submits that both parties are close-door neighbours and due to petty dispute, free fight took place in which both sides inflicted injuries on each other. Allegation of assault is general and omnibus. Case and counter case. Injuries sustained by the injured are simple in nature. It is further submitted that similarly situated co-accused persons have already been granted anticipatory bail by this Court vide order dated 16.04.2024 passed in Cr. Misc. No. 10686 of 2024. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation, injuries and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial
