JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act, 2016.

One hundred twenty two litres Indian made foreign liquor is said to have been recovered from the joint house of the petitioner. Admittedly, petitioner was not caught on the spot. Furthermore, except criminal antecedents of the petitioner, there appears to be nothing against him. Petitioner is in jail custody since 20.9.2019.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.79069 of 2019(5) dt.19-03-2020 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Patna in connection with Special Excise Case No. 1493/2019 (arising out of Hathidah P.S. Case No. 13 of 2019).
