JUSTICE BIRENDRA KUMAR ORAL ORDER 21-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Kahalgoan (Ghogha) P.S. Case No.473 of 2018, registered for the offence punishable under Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

The police got information that two groups were fighting against each other in the village. When the police went there then miscreants fled away. However, some of them arrested and they disclosed the name of the petitioner. Submission is that there is property dispute and some other criminal case have also been lodged in the past by agnate as well as the police. There is no direct material against the petitioner.

No.66502 of 2018(3) dt.21-01-2019 2/2 Considering the aforesaid fact, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Bhagalpur in connection with Kahalgoan (Ghogha) P.S. Case No.473 of 2018 with condition that :- (i) If the petitioner would be accused in other case subsequent to that case, that would be a ground of cancellation of bail to the petitioner in this case by the learned Court below. (ii) As laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
