2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 363 and 366A of the Indian Penal Code.
3. The case of the prosecution is that the petitioner had kidnapped the minor daughter of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that during the course of investigation, victim was recovered and her statement was recorded under Section 164 of the Cr.P.C. in which she has stated that she had called the petitioner, thereafter she went with him to Tamkuhi Road and from there,
Patna High Court CR. MISC. No.88130 of 2024(3) dt.11-02-2025 2/2 they went to Gorakhpur and from Gorakhpur to Lucknow. They took a room on rent after solemnized marriage. It is clear that it is an adolescence affair outside marriage. Moreover, the petitioner is languishing in judicial custody since 09.04.2024 having no criminal antecedent.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kateya P.S. Case No. 121 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge - I, Gopalganj.
