Petitioner seeks bail in Bathnaha P.S. Case No.192 of 2018 registered for the offences punishable under Sections 392 of the Indian Penal Code.

Allegation against the petitioner is to have looted away the motorcycle of the informant and fled away. It appears that the looted motorcycle has been recovered from the possession of the petitioner and the seizure list also bears signature of the petitioner. The investigation is still going on.

Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.

However, after completion of nine months in judicial

No.67927 of 2018(3) dt.30-11-2018 2/2 custody, the petitioner named above be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Bathnaha P.S. Case No.192 of 2018 with following conditions:- (1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
