Petitioner seeks bail in Excise Case No.152 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant intercepted a truck bearing Registration No.MP 07HB-4211 and apprehended the driver and the cleaner of the truck. The informant alleged that the owner of the truck and the petitioner managed to flee away.

Learned counsel for the petitioner submits that the petitioner has no manner of concern with the truck and the seized liquor. The petitioner was produced and remanded in this case from Sakra P.S. Case No.292 of 2019 on 18.10.2019 and since then the petitioner is in custody.

No.77959 of 2019(3) dt.19-03-2020 2/2 Having considered the facts that the petitioner has no manner of concern with the truck and the petitioner was not apprehended on the spot, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Excise Case No.152 of 2019 (P.R. No.37 of 2019).
