Yadav, APP ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 04-12-2019 Instant petition under Sections 439 and 440 of Criminal Procedure Code has been moved for grant of bail in F.I.R. No. 150 of 2019 dated 04.08.2019 registered at Police Station Bachhwara under Section 302/34 of the Indian Penal Code.

I have heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. I have also perused the relevant record of the case, necessary for adjudication of this petition.

At this stage, considering the nature of the offence, the Court is not inclined to grant bail. The investigation is in progress and the offence is serious. There is past history of quarrel, which has surfaced on record.

At this stage, learned counsel submits that petitioner

Patna High Court CR. MISC. No.79213 of 2019(2) dt.04-12-2019 2/2 shall be content if he is permitted to file a fresh application after a period of nine months.

Permission granted, for it is always the petitioner's right to do so in accordance with law.

The petition is accordingly disposed of.
