Petitioner seeks bail in S.T. No.256 of 2018 arising out of Asarganj P.S. Case No.34 of 2018 registered for the offence punishable under Sections 452, 302, 307, 324, 323, 147 and 379 of the Indian Penal Code.

Allegation against the petitioner and other accused, Kundan Yadav, is to have assaulted the deceased Binod Yadav by Khanti and iron rod on his head as a result of which, he succumbed to injury.

Considering the facts and circumstances of the case and also in view of the fact that there is direct allegation against the petitioner, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is

Patna High Court Cr.Misc. No.67891 of 2018(3) dt.13-12-2018 2/2 hereby rejected.

However, the petitioner is granted liberty to renew his prayer for bail after completing one year in jail custody. (S. Kumar, J) Sanjay/- U T
