2. The petitioner is apprehending her arrest connection with Itarhi P.S. Case No. 182 of 2023, F.I.R. dated 26.07.2023 registered for the offences punishable under Section 409 of the Indian Penal Code.

3. Allegation against the petitioner is that she obtained Rs. 40,000/- as first instalment relating to house scheme under the Pradhanmanatri Awas Yojna on the basis of forged document showing herself as Rina Devi W/o Ramnath Ram.

4. Learned counsel for the petitioner submits that the petitioner has clean antecedent and she has been falsely implicated in the present case and as per allegation in the F.I.R. that the petitioner has obtained Rs. 40,000/- as first instalment

Patna High Court CR. MISC. No.4522 of 2024(3) dt.21-03-2024 2/2 relating to house scheme under the Pradhanmantri Awas Yojna on the basis of forged document showing herself as Rina Devi wife of Ramnath Ram. He further submits that the petitioner has been falsely implicated in the present case and she has not obtained the amount in question in the name of Rina Devi in fact she has received the amount in question which was allotted in favour of the petitioner.

Learned APP for the State, on the other hand, on the basis of material available on record and the case diary, vehemently opposed the prayer for bail and submits that it has come during investigation in paragraph nos. 5, 9 and 10 of the case diary that she has obtained the amount of Rs. 40,000/- as first instalment relating to Pradhanmantri Awas Yojna on the basis of the forged document showing herself as Rina Devi wife of Ramnath Ram.

6. Considering the aforesaid facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Itarhi P.S. Case No. 182 of 2023 pending in the Court of Chief Judicial Magistrate, Buxar.

7. Prayer is refused.
