2. The petitioner is seeking regular bail in connection with Haarsidhi P.S. Case No. 325 of 2024 for the offences punishable under Sections 414, 399, 402 of the IPC and Sections 25(1-B)a, 26/35 of the Arms Act.

3. As per prosecution case, in course of vehicle checking by the informant, one Scorpio car tried to flee away but the Scorpio was stopped and five persons were apprehended. On search, one loaded country-made pistol with a cartridge has been recovered from possession of co-accused.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that on similar footing, co-

Patna High Court CR. MISC. No.88403 of 2024(2) dt.20-02-2025 2/2 accused Sahareyar Ansari @ Shareyar Ansari and co-accused Chand Alam have been granted bail by this Court. The petitioner is under custody since 11.06.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari East Champaran in connection with Haarsidhi P.S. Case No. 325 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

7. Before accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any case other than the case as mentioned in para-3 of the bail petition, his bail bond shall not be accepted.
