2. Petitioner seeks bail who is in custody since 12.09.2025 in connection with Medini Chowki P.S. Case No. 83 of 2025, F.I.R. dated 09.06.2025 for the offences punishable under Sections 126(2), 115(2), 303(2), 109(1) and 3(5) of the BNS, 2023 and Section 27 of the Arms Act.

3. According to prosecution case, this petitioner along with other accused persons tried to snatch gold chain from the neck of the informant's son and when he tried to oppose the same then this petitioner fired on the head of the informant's son.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.83373 of 2025(4) dt.19-01-2026 2/2 petitioner has clean antecedent and he has falsely been implicated in the present case. The allegation as alleged in the F.I.R is false and fabricated and the petitioner has not committed any offence as alleged in the F.I.R.

5. Learned Additional Public Prosecutor on the basis of material available on record and the case diary has vehemently opposed the prayer for bail of the petitioner and submits that from perusal of the F.I.R it appears that there is direct and specific allegation against the petitioner that he has fired on the head of the informant's son due to which he received injury which is grievous in nature.

6. Considering the aforesaid facts and circumstances that there is direct and specific allegation of firing attributed against the petitioner supported by the medical evidence, I am not inclined to enlarge the petitioner on bail in connection with Medini Chowki P.S. Case No. 83 of 2025 pending in the court of learned J.M. 1st Class, Lakhisarai.
