JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 07-07-2023 Heard learned counsel for the petitioner and learned APP for the State. Nobody appears on behalf of O.P. No.2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498(A) of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

Petitioner, who is husband of opposite party no.2, is said to have ousted the opposite party no.2 from her matrimonial home in association of his family members over the dowry demand.

By order dated 06.03.2020, the matter was referred to Mediation and Conciliation Centre, Patna High Court, Patna.

Patna High Court CR. MISC. No.77810 of 2019(6) dt.07-07-2023 2/2 Perused the Mediator's Report at Flag 'M'. The learned Mediator has reported that the mediation proceeding has failed as O.P. No.2 has died on 13.09.2021. A copy of death certificate is annexed with the Mediator's Report. In view of the fact that O.P. No.2 has died, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jamui in connection with Complaint Case No.1440C/2017, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
