The writ application has been filed seeking a direction upon the respondent no.3, the District Magistrate, Patna to implement the order dated 23.01.2025 passed in Arms Appeal No. 307 of 2024 by the Divisional Commissioner, Patna Division, Patna, who has been pleased to quash the order impugned dated 03.09.2024 contained in Memo No. 2074/Arms of the District Magistrate, Patna for grant of arms license for N.P. Bore Revolver/Pistol.

At the outset, counsel for the petitioner submits that the petitioner has filed a detailed representation dated 26.04.2025 before the District Magistrate, Patna along with an order dated 23.01.2025 passed by the Divisional Commissioner, Patna Division, Patna in Arms Appeal No. 307 of 2024 for issuance of arms license but, the same has not been adjudicated as yet and is still pending adjudication.

On the other hand, learned counsel for the State submits that since the petitioner's representation for implementation of the order dated 23.01.2025 passed in Arms Appeal No. 307 of 2024 is still pending consideration, the competent authority is required to adjudicate the same by passing an appropriate order in accordance with law.

In view of the submissions made on behalf of the parties, this Court directs that, if there is no legal impediment to adjudicate the application filed for an arms licence to the petitioner in compliance with the order dated 23.01.2025 passed by the Division Commissioner, Patna Division, Patna in Arms Appeal No. 307 of 2024, the District Magistrate, Patna shall take a final decision on the petitioner's application for grant of an arms licence within a period of eight weeks from today. The order so passed shall also be communicated to the petitioner

6. With the aforesaid observations and directions, the instant writ application stands disposed.
