JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Admittedly, the victim has already returned and her statement has been recorded under section 164 of the Cr. P. C. Although the victim has made some allegation against the petitioner in her statement recorded under section 164 of the Cr.P.C but submission on behalf of the petitioner is that the victim was in love with the maternal nephew of the petitioner and she left her home against the wish of her family members and this petitioner opposed the act of the victim and informed the parents of the victim which caused annoyance to the victim and that is the reason the victim stated the name of the petitioner when her statement was recorded under section 164 of the

Patna High Court Cr.Misc. No.67362 of 2018(2) dt.03-12-2018 2/2 Cr.P.C. He further submits that victim is a major girl and coaccused Rahul Kumar, the maternal nephew of the petitioner has already been admitted on anticipatory bail for a Co-ordiante bench of this Court.

In view of the aforesaid submission, the petitioner, in the event o f his arrest or surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate- VII, Patna in connection with Kadamkuan P.S.Case No. 159 of 2018 subject to condition as laid down under section 438(2) of the Cr.
