2. The petitioner is in custody since 29.04.2019 in connection with Sahpur P.S. Case No. 91 of 2019 for the alleged offences under Sections 394, 302, 201 of the Indian Penal Code.
3. It is submitted that the petitioner has been falsely implicated and the FIR is against unknown. The petitioner's name has surfaced on the extra judicial confessional statement of co-accused Vikash Kumar Yadav, except which there is no objective material to connect the petitioner with the alleged occurrence. Recovery of the incriminating articles have been made from the aforesaid co-accused Vikash Kumar Yadav and not from the petitioner. The petitioner's case stands on a better footing than that of Vikash Kumar Yadav, who has been granted bail by this Court in Cr. Misc. No. 51874 of 2019. The petitioner is accused in some prior cases, in all of which he is on bail.
4. Learned APP assisted by learned counsel for the informant appears and has been heard.
5. Be that as it may, let the petitioner above named be
Patna High Court CR. MISC. No.84066 of 2019(3) dt.17-03-2020 2/2 released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM, Ara in connection with Sahpur P.S. Case No. 91 of 2019 on the following conditions:- (i) That one of the bailors shall be a close relative of the petitioner.
(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.
(iii) That the petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (iv) The petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned.
