2. The petitioner seeks bail in connection with Gangta P.S. Case No. 173 of 2023 instituted for the offences under Section 395 of the Indian Penal Code and Section 27 of the Arms Act.

3. The prosecution case, in short, is that when the Informant was going on truck towards Laxmipur from Kharagpur to load sand, six miscreants on three bikes followed him and forcibly entered into his truck and, on the point of pistol, snatched Rs. 2,000/- cash, driving license, Aadhar Card, S.B.I. Passbook, mobile and, thereafter, they fired upon him and fled away.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is not named in the F.I.R. Nothing incriminating has been recovered from the conscious possession of the petitioner or from his house. The name of the petitioner has surfaced in this case in course of investigation in the confessional statement of co-accused Bipin Mandal. The petitioner has not been put on Test Identification Parade and save and except confessional statement recorded by the police, there is no material against the petitioner. So far as seized mobile is concerned, the same was not a looted article rather the mobile was purchased by the petitioner. The petitioner has one criminal antecedent in which he is on bail. The petitioner is languishing in judicial custody since 08.09.2023. The chargesheet has been submitted in this case.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Considering the entire facts and circumstances of the case as also considering the nature of allegation levelled against the petitioner which is general and omnibus, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the
