JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-02-2020 The petitioner seeks regular bail in connection with Saharsa Sadar P.S. Case No. 743 of 2019, registered for offences punishable under Sections 20 and 22 of the NDPS Act. Allegation is of recovery of 15 kg of ganja from the petitioner and one co-accused.

It has been submitted on behalf of the petitioner that the recovered ganja is less than the commercial quantity and considering the same, a coordinate Bench of this Court, vide order dated 29.01.2020 has enlarged the co-accused Nitish Kumar on bail. Further submission is that petitioner has no criminal antecedent and has been in judicial custody since 18.02.2018.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge -cum-Special Judge, N.D.P.S, Saharsa, in connection with Saharsa Sadar P.S. Case No. 743 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
