The petitioner apprehends his arrest in connection with Narpatganj P.S. Case no. 194 of 2018, registered under Section 366 of the Indian Penal Code.
The accusation is that while informant was outside for his livelihood, he received information that his wife along with three children are not at his house. Thereafter, he came at house and on search, he came to know that petitioner has accompanied his wife as well as his three children on assurance to perform marriage. It is alleged that informant also came to know that all the cattle were sold and his wife left the house with Rs. 1,50,000/- and ornaments.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.66772 of 2018(3) dt.05-02-2019 2/2 petitioner has falsely been implicated in this case mere on suspicion. The statement of the informant's wife is detailed in paragraph 64 of the case diary in which she has stated about leaving her matrimonial house due to torturous behaviour of her husband (informant) and she is living at her Myaka. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 194 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
