The petitioner seeks regular bail in connection with Amba P.S. Case No. 57 of 2019, registered for the offence punishable under Sections 392 of the Indian Penal Code. The allegation is regarding unknown miscreants having intercepted the vehicle of the informant whereafter on pistol point, they had snatched the pickup van of the informant. The learned counsel for the petitioner has submitted that the petitioner is innocent, he has not been named in the FIR, no Test Identification Parade has taken place so as to connect the petitioner with the alleged crime and no recovery of the stolen vehicle has been made from the petitioner. Lastly, it is submitted that the name of the petitioner has transpired in the present case upon confessional statement made by the co-accused person, namely, Bhola Singh and the said co-accused person, namely, Bhola Singh has already been granted regular bail by a coordinate Bench of this Court by an order dated 10.12.2019 passed in Criminal Miscellaneous No. 80946 of 2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner, as also taking into account the fact that similarly situated co-accused person, namely, Bhola Singh has already been granted bail by a coordinate Bench of this Court, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Amba P.S.Case No. 57 of 2019.
