02. In the present case, the petitioners seek bail in connection with Derni P.S. Case No. 02 of 2024 registered for the alleged offences under Sections 323, 324, 504, 506, 341, 307, 379/34 of the Indian Penal Code.

03. As per prosecution case, the petitioners and other co-accused persons assaulted the informant after calling him into their house as they were peeved by the refusal of the family of the informant to marry the informant with one of their daughters.

04. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.84583 of 2025(2) dt.10-12-2025 2/3 the petitioners have been falsely implicated in this case and they never assaulted the informant. The allegation of assault by knife to the informant is against some unknown persons as is apparent from the FIR. The true fact of the case is that the dispute arose over love affair of the daughter of the informant and son of petitioner no. 1, namely Nitish Singh, who is petitioner no. 2 herein. For the same occurrence, co-accused Suganti Devi has also lodged FIR. The parties are co-villagers. The injury report of the informant shows only laceration and other simple injuries. The petitioners are having clean antecedent and they are in custody since 26.08.2025 and charge sheet has been submitted.

05. Learned APP opposes the submission made on behalf of the petitioners.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioners, their clean antecedent and submission of charge sheet, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra/concerned Court in connection with

Patna High Court CR. MISC. No.84583 of 2025(2) dt.10-12-2025 3/3 Derni P.S. Case No. 02 of 2024, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions :

(i) One of the bailors will be a close relative of the petitioners.

(ii) The petitioners will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
