2. The petitioners apprehend their arrest in connection with Naugachia P.S. Case No. 186 of 2023 registered for the offence punishable under Sections-323, 307, 379, 504/34 of the Indian Penal Code and 27 of the Arms Act.

3. Prosecution case in short is that while the informant was engaged in selling mangoes to business persons, the accused persons came to the orchard and started abusing him. After arrival of police, they fled away. In the second episode of the occurrence, while the informant was going his house, the accused persons stopped and assaulted him.

4. It has been submitted on behalf of the petitioners that there is case and counter case between the parties. Learned counsel for the petitioners has submitted further that as per FIR, there is allegation that accused persons assaulted the informant and also fired upon him but the informant did not suffer any kind of injury, which reveals the falsity of this case. Learned counsel has also submitted that co-accused Chandan Kumar has been granted anticipatory bail in Cr. Misc. 79408 of 2023 and the case of the petitioners is exactly on similar footing.

5. Learned APP appearing for the State opposed the prayer for grant of anticipatory bail.

6. Considering the above-mentioned facts and circumstances of the case, let the petitioners named above, in the event of their arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Naugachia in connection with Naugachia P.S. Case No. 186 of 2023 subject to the conditions as laid down under Section 438 of the Cr.P.C.
