2. The petitioner seeks bail in connection with Chapra Town P.S. Case No. 256/2025 registered for the offences punishable under Sections 103(1), 3(5) of the B.N.S., 2023.

3. As per the prosecution case, petitioner along with his entire family is alleged to have assaulted his own brother with wicket and fist due to which he died.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. He further submits that from the perusal of the FIR it appears that the intention of the accused persons is not of killing and no offence of murder is made out against the petitioner and other

Learned counsel further submits that petitioner is a man with a clean antecedent and he is in custody since 07.07.2025. The petitioner undertakes to co-operate in the case/ trial.

5. Learned APP for the State as well as learned counsel for the informant have opposed the prayer for regular bail of the petitioner on the ground that the petitioner along with his family members are alleged to have killed his own brother.

6. Considering the FIR and post-mortem report, I am of the view that it may not be a case of culpable homicide amounting to murder. Hence, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saran at Chapra/concerned Court below in connection with Chapra Town P.S. Case No. 256 of 2025 subject to the conditon:- (i) the petitioner after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the Trial Court on each and every date fixed by the trial Court.
