2. The petitioner has prayed for bail in connection with Bheldi P.S. Case No. 35 of 2025 registered for the offence punishable under Sections 308(2) and 308(5) of the B.N.S., 2023.

3. The case of the prosecution in short is that a call was received on the mobile number of the informant from mobile no. 8235372756 and the caller disclosed himself as Saurabh Kumar and demanded Rs. 5,00,000/- as extortion money, failing which, the informant will have to face dire consequences.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the petitioner has submitted that the name of this

Patna High Court CR. MISC. No.83687 of 2025(2) dt.11-12-2025 2/2 petitioner has surfaced on the basis of confessional statement of one co-accused namely, Prince Kumar. It has been submitted that save and except the confessional statement of Prince Kumar there is nothing against the petitioner. He further submits that similarly situated co-accused namely, Mukesh Sharma has been granted bail this Court in Cr. Misc. No. 59469 of 2025. The case of this petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 02.04.2025.

5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedent of four cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Bheldi P.S. Case No. 35 of 2025.
