The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 356 and 382 of the Indian Penal Code.
Prosecution case as lodged by the informant is that the petitioner along with other co-accused looted about 35,000/- to Rs. 40,000/- from the counter of the shop of the informant after hurling chilli powder in the eyes of the informant on 20.08.2019 and fled away.
Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case due to the local politics. He submits that the compromise has been done between the parties outside the court. He submits

No.77976 of 2019(2) dt.02-12-2019 2/2 that on perusal of the compromise petition, it would be clear that the informant has not taken the name of the petitioner and the police with ill motive implicated the petitioner in the present case. He further submits that petitioner bears no criminal antecedent as stated in para-3 of the bail petition. In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VII, Gaya in connection with Delha Police Station Case No. 237 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
