2. The petitioner seeks bail in connection with Ara (Town) P.S. Case No. 1025 of 2023 registered for the offence punishable under Section 379 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of committing theft.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is not named in the FIR nor any suspicion has been raised against him. The petitioner is in jail since 19.12.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara/concerned Court in connection with Ara Town P.S. Case No. 1025 of 2023.

8. The petitioner will also mark attendance in Ara (Muffasil) Police Station District- Bhojpur on every Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
