JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-04-2019 This application, for grant of anticipatory bail, arises out of Pear P.S. Case No. 123 of 2017, disclosing offences under Sections 304(B) and 201/34 of the Indian Penal Code. Petitioner no. 1 is husband, petitioner no. 2 is brother-in-law, petitioner no. 3 is sister -in-law and petitioner no. 4 is the mother-in-law of the deceased and allegation against them is of causing dowry death of the deceased. Submission of learned counsel for the petitioners is that no specific allegation has been attributed to them and as a matter of fact the deceased was traceless, for which, petitioner no. 1 has filed a complaint case before the Chief Judicial Magistrate, Muzaffarpur on 22.09.2017.

No.66932 of 2018(4) dt.09-04-2019 2/2 Learned counsel for the State opposed the prayer for bail and submitted that the complaint case lodged by the petitioner no. 1 is nothing but an afterthought device as the same has been lodged after the information was given by the informant.

Having heard both sides, considering the facts and circumstances of the case so far petitioner no. 1 is concerned, I am not inclined to grant him privilege of anticipatory bail. So far other petitioners are concerned, in the event of their arrest or surrender before the court below within six weeks from the date of receipt/production of a copy of this order be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Judge -Vcum-ACJM, Muzaffarpur, in connection with Pear P.S. Case No. 123 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
