JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-12-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Hathidah P.S. Case No. 66 of 2019 for the offence under Sections 498(A)/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The petitioner is husband of the informant.

Allegation against this petitioner is that the petitioner has meted to his wife with cruelty.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 05.09.2019.

Considering the fact that the petitioner has got no criminal antecedent and also considering the fact that the petitioner is husband and the dispute is between the wife and

No.81477 of 2019(2) dt.11-12-2019 2/2 husband, the Court is inclined to grant bail to the petitioner so that normal conjugal life may be restored between the husband and wife, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Barh, Patna in connection with Hathidah P.S. Case No. 66 of 2019 with the following conditions:

(a) The bailors should be the family members of the petitioner.

(b) The petitioner will keep his wife with full honour and dignity and if any ill treatment is reported by the wife, the court below shall be at liberty to cancel the bail bonds of the petitioner.
