2. The petitioner seeks regular bail in connection with Bihta P.S. Case No. 930 of 2023 registered for the offence under Sections 147, 148, 149, 302 of the Indian Penal Code read with Section 27 of the Arms Act.
3. Seven persons are named in the FIR including this petitioner who have shot at and killed the deceased.
4. Learned counsel for the petitioner submits that innocent and has not committed any crime and he is in custody since 29.09.2023.
5. Learned A.P.P. has vehemently opposed the prayer
Patna High Court CR. MISC. No.3563 of 2025(2) dt.05-02-2025 2/2 for bail.
6. The learned counsel for the informant has submitted that in the trial all the private witnesses have been examined and only two official witnesses i.e., the IO and the Doctor of the case are to be examined.
7. Considering the law laid down by the Hon'ble Supreme Court in the case of X vs. State of Rajasthan, 2024 SCC OnLine SC 3539, this is not a fit case for grant of regular bail.
8. Accordingly, this application for regular bail is dismissed.
9. The prosecution is directed to produce the official witnesses on the dates fixed so that the trial comes to an end. (Sandeep Kumar, J) Shishir/- U T
