The petitioner seeks regular bail in connection with Jandaha PS case no. 181 of 2014 instituted for the offence punishable under Section 395 of Indian Penal Code. The allegation is regarding the accused persons having intercepted the pick-up van in question whereafter they had robbed not only the said pick-up van but also the chocolate loaded in the said vehicle.

The learned counsel for the petitioner has submitted that the petitioner is innocent, no recovery has been made from him, no test identification parade has been held and his name has transpired in the present case only on the basis of the confessional statement of co-accused person namely Aslam who

It is further submitted that at the time of filing of the connected case, the petitioner was having a clean antecedent, however subsequently, he has been implicated in two other cases. The petitioner is said to be languishing in custody since 16.09.2019.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha PS case no. 181 of 2014.
