The petitioner seeks bail in a case registered for the offence punishable under Sections 34, 30(a), 36, 38 and 41(i) of Bihar Excise Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 1097.260 liters of illicit foreign liquor has been recovered from the bush of cemetery. He further submits that the petitioner is in jail custody since 12.11.2019 and petitioner has got clean antecedent.

In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail

No.77783 of 2019(2) dt.29-11-2019 2/2 bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge-cum-Special Judge, Siwan in connection with G.B.Nagar P.S.Case No.258 of 2019, subject to condition that the petitioner will deposit Rs.5,000/- (five thousand) in the Patna High Court, Legal Services Committee, Patna.
