The matter has been taken up through video conferencing.

The petitioner seeks bail in Pranpur (Roshna) P.S. case No. 179 of 2019 registered under Section 307, 326 and other minor Sections of the Indian Penal Code.

The gist of the allegation against the petitioner is that petitioner went to the shop of informant and when the informant refused to serve breakfast to the petitioner the petitioner poured boiling mustard oil on the face of informant. The learned counsel for the petitioner submits that there is counter version being Pranpur (Roshna) P.S. case No. 185 of 2019. The informant of course got injuries on her face, upper arm, shoulder and breast but the burn injuries only 35%. The

The learned APP, however, opposed the prayer for bail.

Perused the FIR and the case diary. It appears that some verbal altercation took place between the petitioner and the informant when the petitioner asked to give breakfast in her shop. The petitioner after such altercation threw boiling mustard oil on the face of informant. The informant got burn injuries but the petitioner is in custody for about nine months and there is counter version.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Katihar in connection with Pranpur (Roshna) P.S. case No. 179 of 2019.
