JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-12-2019 The petitioner seeks regular bail in connection with Mairwa P.S. Case No. 139 of 2019, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation as per F.I.R. is that while the police was checking the vehicles, two persons came but on seeing the police, they started fleeing away and one of them succeeded in fleeing but petitioner was arrested and there is recovery of 24 litres of liquor.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered from the petitioner. Further he has no criminal antecedent and has been in judicial custody since 06.06.2019. Heard learned A.P.P. also.

No.77533 of 2019(2) dt.02-12-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Special Judge, Excise, Siwan, in connection with Mairwa P.S. Case No. 139 of 2019 with subject to the condition that petitioner shall cooperate in disposal of trial and make himself available as and when required by the Trial Court.
