On getting confidential information while the prosecution party was going to conduct raid at the betal shop of petitioner named as "Golu Paan Gumti", it has been alleged that petitioner escaped taking benefit of darkness. From the shop 37 litres of country made wine has been recovered and seized. From the P.O. incorporated under para-7, the boundary has been shown as North-Vijay Sao, South-Asharfi Prasad, East-Road, West-Ramashray Mistri but none had disclosed the petitioner to be the owner of "Golu Paan Gumti". From narration of the written report as well as P.O., it is crystal clear that there happens to be no description of any item being sold/kept at the time of raid nor there happens to be specific disclosure whether at the time of conduction of raid the shop

Patna High Court CR. MISC. No.78732 of 2019(5) dt.13-07-2020 2/2 was opened or locked, customers were present or not and in likewise manner, event prevails during inspection of the P.O. In the aforesaid facts and circumstances of the case, it looks better to direct the petitioner to surrender before the learned lower court and pray for regular bail which the learned lower court will consider in the background of observation made hereinabove favourably.

In terms thereof, this petition stands disposed of. (Aditya Kumar Trivedi, J) perwez U T
