2. Petitioner apprehends his arrest in a case registered for the offences punishable under Section 406, 420, 504, 506 of the Indian Penal Code.
3. The allegation in the FIR is that the petitioner being a land broker had taken a total Rs. 12 lakh from the informant and did not register the land in his favour.
4. Learned counsel for the petitioner submits that it was actually the informant, who was not responding after entering into an agreement and it is only after the petitioner had sent legal notice dated 22.04.2024 that the present case was filed

However, in paragraph-9 of this petition, he has made specific averments that out of Rs. 12 lakh, he has already paid Rs.1,95,000/- and is ready to return the rest of the amount Rs.10,0,5000/- to the informant in some installments.
5. Learned counsel for the OP. No.2 also does not have any objection if the money is returned to the informant.

Considering the above mentioned facts and circumstances and also considering the willingness of the petitioner to pay back the money, I am inclined to grant provisional bail to the petitioner for a period of five months in which the petitioner would making payment of the entire amount of Rs. 10,0,5000/- in five equal installments. Let the petitioner, in the event of his arrest/ surrender within a period of six weeks from today, the petitioner be released on provisional bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in Agamkuan P.S.Case No. 527 of 2024, subject to condition as laid down under Section 438(2) of the Cr.P.C
7. In view of the above, the provisional bail granted to the petitioner would be accepted only after payment of the first installment of Rs.2 lakh. Thereafter, the petitioner would

No.87052 of 2024(4) dt.14-07-2025 3/3 maintain the schedule of payment of Rs. 2 lakh in every month and upon payment of the entire amount of Rs. 10,0,5000/-, the provisional bail granted to the petitioner shall stand confirmed by the learned court concerned. In case the said payment is not made by the petitioner as agreed by him, the learned court concerned is free to take an adverse view. However, it is also expected that once the entire payment is made, the informant would also take steps towards withdrawal of the criminal case against the petitioner.
